Nicole Imboden Foto & Design– Noreon AB

1. Scope of Application

These Terms and Conditions apply to all services provided by Nicole Imboden Photo Design, operated by Noreon AB (Sweden), including but not limited to photo sessions, image editing, image delivery, and image licensing.

2. Conclusion of Contract

A contract is concluded when a service is confirmed in writing (e.g. via email or booking form), or verbally with subsequent confirmation. By placing an order, the client accepts these Terms and Conditions.

3. Services and Payment

Services and prices are based on the current price list, individual offers, or separate written agreements.
All prices include Swedish VAT (moms), unless stated otherwise.
Payment is due within 10 days of the invoice date unless agreed otherwise.

4. Copyright and Ownership

All images are protected by copyright under Swedish and international law.
Nicole Imboden (Noreon AB) remains the sole author and copyright holder of all images.
Upon full payment, the client receives a non-exclusive, non-transferable license to use the delivered images for the agreed-upon purpose (e.g. private use, business website, social media).

5. Mandatory Credit Line

Every published image must include the following photo credit:

This applies to both private and commercial use, including websites, social media, magazines, and print materials.
The credit must be clearly visible and properly attributed.
Use without credit is not permitted and constitutes a copyright violation.
In such cases, additional licensing fees may be charged or legal action may be taken.

6. License Scope and Third-Party Use

Transferring images to third parties or using them commercially (e.g. by agencies, media outlets, vendors) is not allowed without prior written consent.
Unedited files (RAW) remain the sole property of the photographer and are not released.

7. Cancellation Policy

Cancellations up to 48 hours before the session are free of charge.
Cancellations within 48 hours will incur 50% of the agreed fee.
No-shows without notice will be charged the full amount.

8. Liability

The photographer is only liable for intentional or grossly negligent conduct.
She is not liable for image loss or damage after delivery. Clients are responsible for backing up their files.

9. Portfolio Use

The photographer may use images for her own marketing purposes (e.g. website, social media, portfolio, print, competitions), unless the client explicitly opts out in writing before or after the session.

Name, email, phone number, address
Billing and payment details
Photographs in which individuals are identifiable

3. Purpose of Data Processing

Collected data is used exclusively for:

Service delivery and communication
Invoicing and accounting
Fulfilling legal obligations

4. Disclosure to Third Parties

Personal data will not be shared with third parties unless required by law or necessary for service delivery (e.g. accounting, hosting services).

5. Data Subject Rights

You have the right to:

Access your personal data
Request correction or deletion
Restrict or object to data processing
Request data portability

6. Retention

Personal data is stored only as long as necessary for the stated purpose or as required by law.

Image Rights and Photographer’s Use

The photographer reserves the right to use photos from shoots for self-promotion (e.g. website, Instagram, printed materials, exhibitions).
Clients may object in writing at any time before or after the session.
